This Independent Consumer Advocacy Network (ICAN) website is maintained and operated by the Community Service Society of New York (CSS), and overseen by the New York State Department of Health (NYSDOH). Visitors to the ICAN site may be concerned about the information they provide to us, and how we treat that information. This Privacy Policy addresses those concerns. This policy may be changed or updated from time to time.

ICAN uses its best efforts to respect the privacy of its online visitors. At our site, we do not collect personally identifiable information from individuals unless they provide it to us voluntarily and knowingly. This means we do not require you to register or provide information to us in order to view our site.

ICAN gathers personally identifiable data, such as names, addresses, ZIP/postal codes, e-mail addresses, etc., only when voluntarily submitted by a visitor. This information is not sold to third parties. ICAN will share personally identifiable information with third parties only when the person submitting the information authorizes us to share it or we are required to by law.

By giving us this identifying information, you agree that CSS has permission to contact you in the future and solicit your support for our activities, such as trainings or presentations.

This site contains links to other sites. ICAN, CSS, and NYSDOH are not responsible for the privacy practices or the content of such websites.

CSS reserves the right to modify this Privacy Policy at any time. Please check this policy regularly for any updates.

Restriction of Liability

CSS and NYSDOH will not be liable for any damages or injury, including but not limited to, special or consequential damages that result from the use of, or the inability to use, the materials in this site or a site which is linked to this site, even if there is negligence on the part of CSS or NYSDOH or an authorized representative of either has been advised of the possibility of such damages, or both.

The above limitation or exclusion may not apply to you to the extent that applicable law may not allow the limitation or exclusion of liability for incidental or consequential damages. CSS’s and NYSDOH’s total liability to you for all losses, damages, and causes of action (in contract, tort, or otherwise) will not be greater than the amount you paid to access this site.

Restrictions on Use

Except as otherwise indicated elsewhere on this site with respect to a particular portion, file, or document, any person is hereby authorized to view, copy, print, and distribute this document subject to the following conditions:

  • The document may be used for informational, non-commercial purposes only.
  • Permission must be obtained from the licensor for use of any document or portion thereof that has been licensed to CSS.
  • CSS and NYSDOH reserve the right to revoke such authorization at any time, and any such use shall be discontinued immediately upon notice from CSS or NYSDOH.

Submissions

All remarks, suggestions, ideas, graphics or other information communicated to CSS through this site (collectively, the “Submission”) will forever be the property of CSS and NYSDOH. CSS and NYSDOH will not be required to treat any Submission as confidential, and will not be liable for using the Submission for its business (including, without limitation, product or advertising ideas) and will not incur any liability as a result of any similarities that may appear in its future operations.

CSS and NYSDOH will be entitled to use the Submission for any commercial or other purpose whatsoever, without compensation to you or any other person sending the Submission. You acknowledge that you are responsible for whatever material you submit, and you, not CSS or NYSDOH, have full responsibility for the message, including its legality, reliability, appropriateness, originality, and copyright.

Choice of Law

This Agreement is entered into and performed in the State of New York, United States of America, and is governed by and shall be construed in all respects under the laws of New York exclusive of its choice of law or conflict of law provisions. In any claim or action directly or indirectly arising under this Agreement or related to this website, each party irrevocably submits to the exclusive personal jurisdiction of the New York Supreme Court sitting in New York County, New York or if such court does not have subject-matter jurisdiction, then each party irrevocably submits to the exclusive personal jurisdiction of the United States District Court for the Southern District of New York, and whichever of those two courts has jurisdiction each party waives any jurisdictional, venue, or inconvenient forum objections to such court.

If any of the provisions of this Agreement are held by a court or other tribunal of competent jurisdiction not to be enforceable, then such provisions shall be limited or eliminated to the minimum extent necessary so that this Agreement shall otherwise remain in full force and effect. This Agreement constitutes the entire agreement between the parties pertaining to its subject matter. It may not be modified except as described elsewhere in this Agreement. Anything in this website inconsistent with or conflicting with the terms of this Agreement is superseded by the terms of this Agreement.

Termination

CSS or you may terminate this agreement at any time. You may terminate this agreement by destroying: (a) all materials obtained from all CSS sites, and (b) all related documentation and all copies and installations (together, the “Materials”). CSS may terminate this agreement immediately without prior notice if, in its judgment or in the judgment of NYSDOH, you breach any term or condition of this agreement. Upon termination, you must destroy all materials.
